The question comes up in nearly every LTC-funded home care conversation: can we pay a family member (adult child, spouse, or sibling) using the policy? The answer depends on which payout structure the policy uses.

Indemnity policies pay the full daily benefit in cash once the ADL or cognitive trigger is met. Provider type is generally not restricted — family caregivers, privately hired caregivers, and agency caregivers all qualify. Families using indemnity policies to pay a spouse or adult child should note that the payment is typically taxable income to the caregiver, and the caregiver may become a household employee under IRS rules.

Reimbursement policies almost always require a state-licensed home care agency. Paid receipts from a family caregiver do not qualify. The workaround some families use: enroll the family caregiver as an employee of an agency that offers employer-of-record services, so the caregiver becomes an agency employee, generates qualifying receipts, and stays paid — while the family continues to receive care from the same person.

Some newer hybrid policies pay a partial cash benefit plus reimbursement, and some carriers offer specific "informal care" allowances that pay a lower rate for family caregivers. Confirm in writing with the carrier before any family caregiver assumes payment is coming — the assumption failing is a common source of financial strain.
